An appellate court in NY ruled Thursday that a lawsuit by a former "Apprentice" contestant who accused President Trump of unwanted kisses and groping can proceed - shutting down claims by his lawyers that Trump is immune from defamation lawsuits while in office and raising the specter that he will have to sit for sworn questioning.

Trump's attorney, Marc Kasowitz, said that he disagreed with the ruling and that the president plans to appeal to the New York Court of Appeals, "which we expect will agree with the dissent".

Trump's lawyers have said the case shouldn't go forward while he's in office.

In a defamation lawsuit filed by attorneys for Summer Zervos, a former contestant on "The Apprentice", Judge Dianne Renwick wrote, "the President is still a person, and he is not above the law".

But the split decision likely foreshadows an appeal, perhaps to the state's highest court, the Court of Appeals.

The reality TV contestant's lawsuit claims that the President's repeated denials of her sexual misconduct allegations are factual falsehoods that have subjected her to threats and cost her business at her Southern California restaurant.

"We are very pleased that the First Department has affirmed once again that Defendant "is not above the law, '" Zervos" lawyer, Mariann Wang, said in a statement.

The trial judge has allowed discovery to move forward while the president's appeal was pending.

Attorneys for President Trump argued that as President, he can not be sued.

She says she didn't go public with her allegations for nearly a decade because she admired Trump as a businessman and thought he had had just a couple of episodes of bad behavior with her.

The foundation case likely will proceed.

Also on Thursday, James entered a new legal filing with what she said were "undisputed" facts about the Trump Foundation. She alleges that Trump "ambushed" her on multiple occasions, starting in 2007, and kissed her on the mouth, touched her breast and rubbed his genitals against her. It seeks shorter-term bans on charity service for Trump's children Eric, Ivanka and Donald Jr., who were all members of the foundation's board.

The Zervos case is not the only defamation lawsuit Trump has faced as president. In short, she was able to file a suit against Trump because he publicly called her a liar. That lawsuit was dismissed by a federal judge in October.

But the Zervos case differs in several key aspects, legal experts have noted.

Zervos was among more than a dozen women who came forward late in the 2016 presidential campaign to say that Mr. Trump had sexually harassed or assaulted them.

Trump denied the allegation, writing in a statement at the time that he "never met her at a hotel or greeted her inappropriately".
