Jussie Smollett "Confident" At Prelim Court Hearing

The actor has been indicted on 16 felony counts.

Police allege that Smollett, who is black and gay, staged the January 29 attack because he was unhappy with his salary and wanted to promote his career.

Each count carries a maximum penalty of three years in prison and a $25,000 fine. "This redundant and vindictive indictment is nothing more than a desperate attempt to make headlines in order to distract from the internal investigation launched to investigate the outrageous leaking of false information by the Chicago Police Department and the shameless and illegal invasion of Jussie's privacy in tampering with his medical records".

Each count covers various alleged acts that Smollett falsely described to the officers-including that he was hit by two men, that they yelled racial and homophobic slurs and poured a chemical on him.

But the 16-page document includes other elements of the account that Smollett had stood by for weeks.

News of the assault spread quickly on social media, with many expressing outrage while others wondered whether the story was fabricated even as Chicago police insisted their detectives were treating the matter seriously. Days before the January 29 incident, a letter threatening Smollett was sent to the studio where the television show is filmed - a letter Chicago Police Supt.

An attorney for Ola and Abel Osundairo said they feel "betrayed" by the actor and are trying "to pick up the pieces of what this has done to their lives".

Police investigated Smollett's allegations for three weeks, and have said it was not until the Osundairo brothers had been in custody for almost two days that the investigation switched from an alleged hate crime to an alleged hoax. Details in some of those statements were different, the indictment says.

"Empire" debuted on Fox in 2015 and has earned multiple Emmy nominations.

Jussie Smollett was all business as he walked into court on Tuesday.
