NASCAR CEO and Chairman Brian France was charged Sunday night for aggravated driving while intoxicated and criminal possession of a controlled substance.

As law enforcement communicated with him, they became suspicious that he was intoxicated and had him undergo a field sobriety test, which he reportedly failed.

France was held overnight in The Hamptons before being released just after 9 a.m. ET on Monday after his arraignment.

"We are aware of an incident that occurred (Sunday) night and are in the process of gathering information".

France was named in 2003 as the CEO of NASCAR, which was founded by his grandfather, Bill France Sr., in 1948. Trump initially took that endorsement as an endorsement of NASCAR while NASCAR spokespeople quickly had to clarify that France was making a "personal" endorsement of the then-candidate. The legal limit in NY is 0.08.

Brian France made a surprise appearance on Sirius XM NASCAR Radio on Wednesday afternoon and addressed rumors that his family was exploring a sale of the sanctioning body.It was his first public.
