An Illinois man who allegedly harassed a woman for wearing a Puerto Rican flag T-shirt in a now-viral video was charged with a felony hate crime on Thursday.

Mia Irizarry complained that a man at Caldwell Woods was questioning her citizenship and telling her she shouldn't be wearing the shirt, although Puerto Rico is a us commonwealth.

"You should not be wearing that in the United States of America", the man, identified as 62-year-old Timothy Trybus shouts. The Tribune said these are "enhancements" on prior charges of misdemeanor assault and disorderly conduct.

Trybus is scheduled for his first court appearance August 1, the Cook County Circuit Court said.

Irizarry said she received an apology from the forest preserve shortly after she posted the video.

"I have full faith in our system and the process and the investigation that is going underway", Arroyo said. I do not feel comfortable with him here.

The video shows the officer appearing not to move any closer to the pair or do anything to actively end the situation.

Several different versions of the video have appeared across social media, but they all show a man, later identified by authorities as Trybus, berating a woman.

Cook County Commissioner Jesús "Chuy" García had called for such charges against Trybus a day earlier.

"You should not be wearing that in the United States of America", the man can be heard saying to her on a video she posted on Facebook.

I showed my official ID as a Member of Congress, to which the officer said, "I don't think so", indicating that she thought my ID was a fake and that I couldn't possibly be a Member of Congress.

The Forest Preserve Superintendent will speak more about the matter Thursday morning.

Eventually the first officer on the scene takes notes of Irizarry's account of the incident and says that he was at the scene due to the separate incident, noting that she was not being attacked though acknowledging she felt threatened.

The officer can then be seen talking to the man who gesticulates back and tells him to "shut the f*** up".

I was new and I was dressed somewhat casually because we were just returning from a Puerto Rican celebration and my daughter was carrying a Puerto Rican flag. The island is a USA commonwealth, and Puerto Ricans are American citizens.
